2. The petitioner seeks bail in connection with Bakhtiyarpur (Patna) P.S. Case No. 223 of 2023, instituted under Sections 302/34 of the Indian Penal Code.
3. As per the prosecution case, the petitioner along with other accused persons has killed the son of the informant.
4. This is the 2nd attempt of bail application and the following order was passed which reads as follows:- Heard learned counsel for the petitioner and learned APP for the State.
2. This application has been filed for grant of regular bail in connection with of Bakhtiarpur P.S.
Case No. 223 of 2023, registered for the offence punishable under Sections 302/34 of the Indian Penal Code.
3. The petitioner and
Patna High Court CR. MISC. No.82360 of 2024(5) dt.09-02-2026 2/2 others are accused of killing the deceased. The petitioner is named in the F.I.R. Earlier the deceased had asked for money for him travelling in Hawa Hawai. There is direct allegation of killing the deceased against the petitioner, I am not inclined to grant bail to the petitioner.
4. Accordingly, the prayer of bail of the petitioner is rejected herewith.
5. The trial court is directed to expedite the trial of the petitioner and conclude the same at the earliest.
5. Learned counsel appearing for the petitioner submits that the certified copy of the F.I.R. has been filed by him and defect has been removed. He further submits that the trial has also commenced and some witnesses have also been examined.
6. Considering the gravity of the offence and the fact that the trial has commenced and witnesses have also been examined, I am not inclined to review my earlier order.
