2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 420, 406 and 34 of the Indian Penal Code.
3. As per the prosecution case, this petitioner along with co-accused Ram Sahay Kumar received Rs. 15,00,000/- (fifteen lakh rupees) from the informant in the name of execution of land pertaining to Mauja- Muther, Khata No. 354, Plot No. 1382, measuring 3.125 decimals and even after repeated requests, this petitioner along with co-accused Ram Sahay Kumar neither executed the land nor returned the consideration money to the informant.
4. It is submitted by learned counsel for the petitioner that the petitioner is only alleged to have introduced Ram Sahay
Patna High Court CR. MISC. No.75105 of 2023(2) dt.29-11-2023 2/2 Kumar to the informant and was witness to the agreement of sale. There is no allegation that he received any money from the informant in lieu of execution of land. Petitioner claims clean antecedents.
5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
6. Considering the aforesaid facts and circumstances, the prayer for anticipatory bail of the petitioner is allowed.
7. Accordingly, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Jehanabad, in connection with Jehanabad Nagar (Karauna O.P.) P.S. Case No.534 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
