The petitioner seeks regular bail in connection with Mithanpura P.S.Case No.184 of 2017 registered for offences punishable under Sections 25(1-B)a, 26/35 of the Indian Penal Code.

Allegation against the petitioner is about recovery fo one country-made pistol.

Submission of the learned counsel for the petitioner is that he has been falsely implicated in this case. The petitioner is in custody for more than three months and the petitioner is accused in one more case but he is on bail in that case. Heard learned A.P.P. also.

Having heard both sides and in view of allegation, this

No.46269 of 2017 (2) dt.20-09-2017 application is disposed of with direction that once the charge is framed or he completes three five more months period in judicial custody, whichever is earlier, the learned court below shall release the petitioner in connection with Mithanpura P.S.Case No.184 of 2017 to his own satisfaction.

With the aforesaid observation, this application is disposed of.
