The petitioner is in custody in connection with Ghoshi P.S. Case No.171 of 2017, a case under Section 304B/201/34 of the Indian Penal Code, pending in the Court of learned Sub-Divisional Judicial Magistrate, Jehanabad. Petitioner is husband of the victim of dowry death. Allegation is of demand of dowry and torture for the same against the petitioner soon before her death. The family members of the deceased have supported the allegation of demand of dowry and torture.
Submission is that the petitioner is in custody since 21.10.2017. Allegation is not specific. Petitioner is father of two
Patna High Court Cr.Misc. No.31474 of 2018 (5) dt.30-07-2018 P2/ school going children. The mother-in-law has already been allowed anticipatory bail by a coordinate Bench of this Court in Cr. Misc. No.14904 of 2018.
Considering the nature of allegation against the petitioner, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail is refused. The learned trial Court is directed to expedite the trial and conclude the same within nine months, failing which the petitioner would be at liberty to renew the prayer for bail before the trial judge itself, who shall pass a reasoned order.
