2. The petitioner seeks bail in a case registered for offence under Sections 30(a), 32(1), 32(2), 41 of the Bihar Prohibition and Excise Act.

3. Total 3557.52 liters of illicit foreign liquor has been recovered from a container, bearing registration no. HR55-AD7666, of which, this petitioner is alleged to be driver.

4. Learned counsel for the petitioner submits that petitioner was simply a driver and on the instruction of owner, he was driving the said container and was not aware about the consignment, which was being transported in the container. Nothing has been recovered from the conscious possession of petitioner. Petitioner is in custody since 22.08.2024, having no criminal antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail petition.

6. Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Judge 1st, Khagaria in connection with Mansi P.S. Case No. 215 of 2024.
