This application is for grant of regular bail in connection with S.Tr. No.427 of 2017, arising out of Bikramganj P.S.Case nO.67 of 2017, for the offences under Sections 304(B), 201, 34 of the Indian Penal Code.
Allegation against the petitioner who happens to be husband is of demand of dowry and causing death of the deceased by setting her on fire.
Submission of the learned counsel for the petitioner is that while she was boiling milk she received burn injuries due to which she succumbed to the injuries, information was given to the informant and thereafter the dead body was disposed of. He is in custody for more than one year.
Patna High Court Cr.Misc. No.41933 of 2018 (5) dt.01-10-2018 2/2 Heard learned A.P.P. also, who has opposed the prayer for bail stating that eh deceased was burn to death. And the information was not given to the information or to the police. Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage, however, since the petitioner is in custody for more than one year, the learned trial court is directed to expedite the trial .
With the aforesaid observation, this application is dismissed.
