====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 03-11-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in connection with Chenari P.S. Case No.287 of 2025 instituted under Sections 126(2), 115(2), 109(1), 351(2), 352, 3(5) of the B.N.S., 2023.

3. As per prosecution case, there is allegation against the petitioner alongwith two other co-accused persons that they had assaulted the informant and his nephew, namely, Pankaj Kumar on their head causing injury to them.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case due to previous enmity. He further submits that there is case and counter case between the parties. Learned counsel submits that an altercation took place in which both the parties received injury. The injury on the informant's side is simple in

Learned counsel submits that petitioner has got clean antecedent and he undertakes to cooperate in the investigation and trial.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount to each to the satisfaction of the learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Chenari P.S. Case No.287 of 2025, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
