JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-03-2020 Heard learned counsel for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 406, 420, 467, 468 of the Indian Penal Code and Sections 82 and 83 the Registration Act, 1908.
The prosecution case as per the written report of Nilesh Kumar submitted before the S.H.O., Town Police Station, Vaishali at Hazipur is to the effect that one Sheo Kumar Singh made a complaint to the District Magistrate, Vaishali at Hazipur to the effect that the petitioner on the basis of forged power of attorney registered in West Bengal got transferred 472.50 decimals of land of the complainant, Sanjay Singh and Praveen Kumar.
It is submitted by learned counsel for the petitioner that the case has been lodged in the background that the

No.65608 of 2019(3) dt.05-03-2020 2/3 petitioner had already paid Rupees Twelve Lac as advance consideratino amount through RTGS to the complainant Sheo Kumar Singh, Sanjay Singh and Praveen Kumar for transfer of 2.69 of decimals of his land for a total consideration amount of Rupees Seventeen Lakhs, but neither the land was transferred nor the consideration amount taken in advance has been returned to the petitioner and in order to grab such amount, the present false case has been lodged by the complainant against the petitioner. Moreover, the petitioner has lodged a case being Sadar P.S. Case No. 284 of 2019, levelling accusation under Sections 420, 406, 467, 468, 469, 470, 504, 506 and 120B of the I.P.C. It is further submitted that the petitioner is accused in one other case being Complaint Case No.481 of 2015, apart from the present case. Learned APP for the State after going through the case diary submits that this is not in dispute that on the basis of forged power of attorney, the petitioner transferred the land of the informant.
Considering the nature of accusation, this Court is not inclined to release the petitioner on anticipatory bail. Let the learned Court below consider the prayer for regular bail of the petitioner without being prejudiced by this
Patna High Court CR. MISC. No.65608 of 2019(3) dt.05-03-2020 3/3 order, if the petitioner surrenders within a period of six weeks, in connection with Hajipur Town P.S. Case No. 284 of 2019, pending before the learned CJM, Vaishali at Hajipur. With the above observation, this application is, accordingly, disposed of.
