The petitioner, who is in custody, seeks bail in connection with Parwatta P.S. Case No. 59 of 2015 registered for the offence punishable under Sections 302, 120(B)/34 of the Indian Penal Code and Section 27 of Arms Act. Informant is the elder brother of deceased, who in his fardbeyan has stated that on 02.12.2015 at about 6.30 PM when he was talking with his brother then three named accused fired upon his brother and he died on the spot. Petitioner is not named in the FIR. His name has transpired in this case on the basis of confessional statement made by Sanjay Kumar Singh and except that confessional statement there is no

It has further been submitted that similarly situated persons have granted anticipatory bail and regular bail by a different Co-ordinate bench of this Court vide order dated 03.03.2016, 28.03.2016 and 19.05.2016 passed in Criminal Miscellaneous Nos. 2443 of 2016, Cr. Misc. No. 12623 of 2016 and Cr. Misc. No. 21403 of 2016 respectively. Petitioner is in custody since 09.01.2018. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.-III, Nawgachia (Bhagalpur), in connection with Parwatta P.S. Case No. 59 of 2015.
