The petitioner apprehends his arrest in connection with Birpur P.S. Case No. 166 of 2019, registered for the offence punishable under Section 379 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case on the basis of confessional statement of co-accused. Further submission is that nothing has been recovered from possession of the petitioner. The petitioner has no criminal antecedent.

Learned A.P.P. appearing for the State submits that recovery of alleged motorcycle has been made from the house of the petitioner.

Patna High Court CR. MISC. No.70978 of 2019(2) dt.24-01-2020 2/2 Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, I am not inclined to grant bail to the petitioner.

Accordingly, this application is rejected.
