JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-12-2022 The short prayer made by the petitioner in the present writ petition is that despite the petitioner having filed an appeal before the Collector, Katihar against the order dated 29.10.2022, passed by the Circle Officer, Pranpur, Katihar in Encroachment Case No. 2/2022-23, the same has neither been numbered nor is being heard, however, coercive steps are being sought to be taken against the petitioner, hence directions be issued to the Respondents to number the Appeal filed by the petitioner & hear the same forthwith.

Patna High Court CWJC No.17324 of 2022(2) dt.21-12-2022 2/2 Having regard to the limited prayer made by the petitioner in the present writ petition, I deem it fit and proper to dispose of the present writ petition with a direction to the Collector, Katihar to number the aforesaid miscellaneous case / appeal, hear the same and pass a reasoned and a speaking order, in accordance with law, forthwith and till then, status quo, existing as on today qua the land / house of the petitioner in question, shall be maintained.
