====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 05-09-2018 Heard learned counsel for petitioner and learned counsel for the State.

Petitioner, who is in custody, seeks bail in connection with Bhorey P.S. Case No. 24 of 2018 (G.R. No. 213 of 2018) registered for the offences punishable under Sections 413, 414, 467, 468 and 420 of the Indian Penal Code. Informant is the police Officer who in his written complaint has stated that on 12.01.2018 at about 14:10 hours he received a secret information that the one Ajay Rai, deals in the stolen motorcycle and on the said information, he reached the house of Ajay Rai at 14:50 hours and found two persons sitting on a motorcycle and both of them were apprehended and motorcycle was seized. Patna High Court Cr.Misc. No.37511 of 2018(3) dt.05-09-2018 2/2 name as Ajay Rai and the Jhuna Pandey (petitioner). It has been submitted on behalf of the petitioner that he is innocent and committed no offence. The name of petitioner surfaced in this case on the basis of confessional statement of co-accused Ajay Rai and except that confession there is no incriminating material against the petitioner. He has got no criminal antecedent and he is in custody since 12.01.2018. It has been further submitted that one similarly placed co-accused has been granted bail by co-ordinate Bench of this Court in Cr. Misc. No. 27348 of 2018 vide order dated 24.05.2018.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate XII, Gopalganj in connection with Bhorey P.S. Case No. 24 of 2018 (G.R. No. 213 of 2018).
