The petitioner seeks bail in connection with Sherghati P.S. Case No. 393 of 2019 for the offence under Sections 30(a), 30(d) of the Bihar Prohibition and Exice Act. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has not committed any offence. Nothing has been recovered from the conscious possession of the petitioner. The petitioner, who is of clean antecedent, is rotting in judicial custody since 16.09.2019.

Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on

Patna High Court CR. MISC. No.65349 of 2019(2) dt.04-11-2019 2/2 furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Excise Judge, Gaya in connection with Sherghati P.S. Case No. 393 of 2019.
