The petitioner seeks bail in connection with Mansi P.S. Case No. 174/2016, corresponding to S.Tr. No. 395/2016 dated 14.09.2016 instituted for the offences under Sections 399 and 402 of the Indian Penal Code read with Sections 25(1-b)a, 26 and 35 of the Arms Act.

On 14.09.2016, it was reliably learnt that some miscreants have assembled at a place for committing crime. On raid, three persons were arrested, viz. Awadh Yadav, Krishna Kumar Yadav and Sarjan Yadav. They were found to be in possession of firearms. One of the apprehended accused persons, viz. Krishna Kumar Yadav has named the petitioner also as one of their associates.

Patna High Court Cr.Misc. No.55558 of 2017 (2) dt.04-12-2017 2/2 The petitioner is in custody since 19.07.2017 and in four cases, in which he has been made accused in the past, he is on bail. One of the co-accused, viz. Sarjan Yadav has been granted bail by a co-ordinate Bench of this Court vide order dated 16.03.2017 passed in Cr. Misc. No. 9731/2017. Taking into account the aforesaid facts, this Court is inclined to grant bail to the petitioner as well. The petitioner above named is directed to be released on bail on his furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IIIrd, Khagaria in connection with Mansi P.S. Case No. 174/2016, corresponding to S.Tr. No. 395/2016.
