The petitioner is languishing in custody in a case registered for the offences punishable under Sections 395, 412, 120(B) of the Indian Penal Code. It is alleged by the informant that he along with his companion were intercepted by four unknown criminals who looted his bike, mobile and cash of Rs. 700/- along with other articles as detailed in the F.I.R. It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner is not named
Patna High Court CR. MISC. No.72282 of 2022(3) dt.01-05-2023 2/2 in the F.I.R. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has not been put on T.I.P. Moreover, other similarly situated co-accused has been granted bail by a coordinate Bench of this Court vide order dated 13.05.2022 passed in Cr. Misc. No. 72576 of 2021. The petitioner is languishing in custody since 22.04.2022.
In the facts and circumstance of the case, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Sheohar/concerned Court in connection with Piprahi P.S. Case No. 51 of 2021, Sessions Trial No. 89 of 2021.
