2. The petitioner seeks bail in connection with Barun P.S. Case No. 172 of 2023 registered for the offence punishable under Section 366(A) of the Indian Penal Code and 8/12 of the POCSO Act.

3. As per the prosecution case, the petitioner is accused of kidnapping the victim.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The statement of the victim girl does not support the prosecution case. The petitioner is in jail since 14.08.2023 having clean antecedent.

5. Learned APP appearing for the State opposes the

Patna High Court CR. MISC. No.75862 of 2023(3) dt.27-02-2024 2/2 prayer for regular bail of the petitioner.

6. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-VIcum-Exclusive Special Judge POCSO Act, Aurangabad/ concerned Court in connection with Barun P.S. Case No. 172 of 2023.
