Petitioner, who is in custody, seeks bail in connection with Sheosagar (Baddi) P.S. Case No. 391 of 2017 registered for the offences punishable under Sections 8(C), 22/27 (A) of N.D.P.S. Act.
Informant is the police officer who in his written complaint has stated that on 15.12.2017 he received a secret information about Bipin Singh indulged in trade of Ganja. On the said information he along with other police personnel raided the house of petitioner and recovered 5 kilogram of Ganja in a plastic bag and thereafter seizure list was prepared in presence of witnesses.
Patna High Court Cr.Misc. No.36336 of 2018(5) dt.05-09-2018 2/2 It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case. Nothing has been recovered from the conscious possession of petitioner. He has no criminal antecedent and he is in custody since 16.12.2017. It has been further submitted that similarly placed co-accused, namely, Ayodhaya Bind and Bindhyachal Paswan has been granted bail by co-ordinate Bench of this Court in Cr. Misc. No. 17812 of 2018 and 19831 of 2018 vide order dated 03.05.2018 and 11.04.2018 respectively. Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Additional Sessions Judge, Rohtas at Sasaram in connection with Sheosagar (Baddi) P.S.
