JUSTICE PRABHAT KUMAR JHA ORAL ORDER 18-11-2019 Heard Mr. Arshad Alam, learned counsel appearing on behalf of the petitioner and the learned counsel for the State. The petitioner seeks direction to the respondent Nos.2 and 3 to take all necessary steps for cancellation of sale deeds executed by the builder who had entered into an agreement with the petitioner for development of the land of the petitioner and the builder had to give some portions of the flats to the petitioner but the builder also sold the share of the petitioner to other persons violating the terms and conditions of the agreement.

Patna High Court CWJC No.21959 of 2019(2) dt.18-11-2019 2/2 After some argument, learned counsel for the petitioner seeks permission to withdraw this writ petition with liberty to the petitioner to file petition before the Collector or any other appropriate authority to examine the matter and cancel the sale deeds executed by the builder with regard to the flats felling in the share of the petitioner.

Accordingly, this writ petition is disposed of with the aforesaid liberty.
