JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 18-10-2017 Heard learned counsel for the petitioner and the State. Petitioner is apprehending arrest in connection with Rajiv Nagar P.S. Case No. 71 of 2017 for an offence under sections 420, 467, 468, and 471 of the Indian Penal Code and 3 of the Prevention of Damage to Public Property Act. From perusal of the FIR, it appears that unauthorized construction was done by one Arbind Singh on the land acquired by the State in Nepali Nagar.

Counsel for the petitioner submits that similarly circumstanced other co- accused Chandan @ Chandan Kumar was granted anticipatory bail in Cr. Misc. No. 26660 of 2017 vide order dated 6.7.2017.

Considering the peculiar facts and the also the fact

Patna High Court Cr.Misc. No.49251 of 2017 (2) dt.18-10-2017 2/2 that similarly circumstanced other co-accused has been granted anticipatory bail, let the petitioner, named above, be released on bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Abhijit Kumar, Additional Chief Judicial Magistrate, Patna, in connection with Rajiv Nagar P.S. Case No. 71 of 2017, subject to the condition as laid down under section 438(2) of the Cr.P.C.
