ANJANA MISHRA ORAL ORDER 20-08-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 24.02.2018 in connection with Chandauti P.S. Case No.34 of 2018 registered for the offence under Sections 399 and 402 of the Indian Penal Code and Section 3/4/5 of the Explosive Substance Act. Learned counsel for the petitioner submits that the only allegation against the petitioner is that he is suspected to have been planning to commit dacoity in the house of the informant and had come equipped with explosive, which has resulted in his own injury. He further submits that the entire case is based on suspicion and all the witnesses have told before the police that they had come to the place only after the alleged

Patna High Court Cr.Misc. No.34014 of 2018 (3) dt.20-08-2018 2/2 explosion. Learned counsel for the petitioner submits that the petitioner is himself the victim of the explosion and that he is languishing in jail merely on suspicion.

In view of the aforementioned facts and circumstances and that the petitioner is a man of clean antecedents, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya, in connection with Chandauti P.S. Case No.34 of 2018.
