JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Paras Bigha P.S. Case No. 86 of 2018 registered for the offences punishable under Section 302 of the Indian Penal Code and Section 27 of the Arms Act. As per FIR while nephew of the informant was proceeding for Arwal by his motorcycle to join his duties he was murdered by unknown persons and petitioner is not named in the FIR and later on, on the basis of CCTV footage some accused persons were arrested, who disclosed the name of the petitioner stating that he was in close contact with the accused persons on mobile and he was giving information about activities of the police.

Submission of learned counsel for the petitioner is that he has been made accused only on the basis of suspicion

Patna High Court CR. MISC. No.68597 of 2019(2) dt.25-10-2019 2/2 and as he was talking with another person he has been made accused and there is no other circumstances against him. Heard learned APP, who has opposed the prayer for anticipatory bail of the petitioner.

In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. He may surrender and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order.

This application is, accordingly, dismissed.
