The petitioner, who is in custody, seeks bail in connection with Paraiya P.S. Case No. 60 of 2018 registered for the offence punishable under Sections 376 and 511 of the Indian Penal Code and 8 POCSO Act.

Informant Guriya Kumari has alleged in the FIR that in the night of 03.06.2018 she and two another girls were sleeping on the roof after taking dinner. At about 12.30 AM petitioner entered at her roof from the boundary wall and with wrong intention he started removing her cloths and on her raising alarm people gathered there and caught him. Learned counsel for the petitioner submitted that

Patna High Court Cr.Misc. No.38347 of 2018(3) dt.24-08-2018 2/2 he is innocent and has been falsely implicated in this case with ulterior motive. It has further been submitted that petitioner has no criminal antecedent and he is in custody since 06.05.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, POCSO, Gaya, in connection with Paraiya P.S. Case No. 60 of 2018.
