The petitioner seeks bail in a case registered for the offence punishable under Sections 386/387 of the Indian Penal Code. The prosecution case as per FIR is that on 25.04.2019 in the morning 05.00 hrs one phone has come on his mobile bearing mobile no. 08002005712 and demanded Rs. 10 lakh otherwise your son has been kidnapped again on 26.04.2019 in between 07 to 09 hrs in the morning, phone has come by same Number by bearing Mobile No. 7070535070 on the basis of said written application the FIR has been lodged.

Learned counsel for the petitioner submits that the petitioner is not named in the FIR. On the basis of confessional statement of petitioner he has been dragged in the present case except this no material against the petitioner.

Patna High Court CR. MISC. No. 65420 of 2019(2) dt.05-11-2019 2/2 It has been submitted on behalf of the petitioner that the petitioner is in custody since 18.05.2019 and has no criminal antecedent. Charge sheet has been submitted in this case on 16.07.2019.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-4, Saran at Chapra, in connection with Panapur P.S. Case No. 80 of 2019, subject to the following conditions:

(1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by Court and his absence on two consecutive dates without sufficient reasons, his bail bond shall be cancelled by the court below.

(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner. (Anjani Kumar Sharan, J) amitkumar/- U T
