This application is for grant of regular bail in connection with Sessions Trial No.430 of 2017 arising out of Khagaria (Gangaur) P.S.Case No.629 of 2016 for the offences under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation against the petitioner is of firing on the deceased causing his death.
Submission of the learned counsel for the petitioner is that he is in custody since 19.7.2017 and there is no substantive progress in the trial.
Heard learned A.P.P. also and from perusal of the
Patna High Court Cr.Misc. No.39154 of 2018 (4) dt.01-11-2018 2/2 report it appears that in this case three witnesses have been examined and the case is fixed for the evidence of I.O. and the Doctor.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage, however, the learned trial court is directed to expedite the trial.
With the aforesaid observation, this application is dismissed.
