25-07-2023 Heard learned counsel for the petitioners, State and informant/opposite party no. 2.

2. The petitioners apprehend their arrest in a case registered for the offence under Sections 406 and 420 of the Indian Penal Code.

3. In this case, a supplementary affidavit has been filed on behalf of petitioners and in paragraph - 4 of the same, it is stated that petitioners are ready to refund the cheque amount i.e. Rs. 10,00,000/- (Rupees Ten lacs), out of which, 30% of the said amount at the time of surrender/furnishing bail-bond and rest amount in equal installments to the informant.

4. Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks

Patna High Court CR. MISC. No.1795 of 2023(8) dt.25-07-2023 2/2 from today, let the above named petitioners be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna in connection with Patrakar Nagar P.S. Case No. 121 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, in the light of following terms and conditions: A. At the time of furnishing bail-bond Rs. 3,00,000/- (Rupees three lacs) shall be deposited to the informant through Bank Draft.

B. Rest amount i.e. Rs. 7,00,000/- (Rupees seven lacs) in seven monthly installment of Rs. 1,00,000/- (Rupees one lac) within a period of one year from the date of furnishing bailbond. C. If petitioners fail to comply with the aforesaid direction of this Court, the Court below is free to cancel the bail-bonds of the petitioners.
