====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 17-09-2018 Since, both the cases arise from same P.S. as such they are taken up together for consideration. Heard learned counsel for petitioners and learned counsel for the State.

Petitioners, who are in custody, seeks bail in connection with Raxaul P.S. Case No. 08 of 2018 registered for

Patna High Court Cr.Misc. No.38077 of 2018(5) dt.17-09-2018 2/2 the offences punishable under Sections 302, 201/34 of the Indian Penal Code.

Allegation against the petitioners is of killing the husband of Usha Devi due to illicit relationship between Dipawali Devi (petitioner) and her husband deceased Raj Kumar Kushwaha.

It has been submitted on behalf of the petitioners that they are innocent and have committed no offence. FIR is against unknown. They have been named only on basis of suspicion. They have been falsely implicated in this case due to land dispute between the parties. Petitioners have no criminal antecedent. They are in custody since 16.03.2018. Considering the aforesaid fact and circumstances of the case, let the petitioners named above be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., East Champaran at Motihari in connection with Raxaul P.S. Case No. 08 of 2018.
