25-07-2023 Heard learned counsel for the petitioners, State and informant.

2. The petitioner apprehends his arrest in a case registered for the offence under Sections 406 and 420 of the Indian Penal Code.

3. In this case, a supplementary affidavit has been filed on behalf of petitioner and in paragraph - 4 of the same, it is stated that petitioner is ready and offers to refund the cheque amount i.e. Rs. 20,00,000/- (Rupees Twenty lacs), out of which, 30% of the said amount at the time of surrender/furnishing bailbond and rest amount in equal installments to the informant.

4. Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two

No.8865 of 2023(10) dt.25-07-2023 2/2 sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna in connection with Patrakar Nagar P.S. Case No. 117 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, in the light of following terms and conditions: A. At the time of furnishing bail-bond Rs. 6,00,000/- (Rupees six lacs) shall be deposited to the informant through Bank Draft.

B. Rest amount i.e. Rs. 14,00,000/- (Rupees fourteen lacs) shall be refunded to informant through bank draft in twelve months within a period of one year from the date of furnishing bail-bond. The monthly installment of 1st month to 8th month shall be of Rs. 1,25,000/- (Rupees one lac twenty five thousand) each [Total will be Rs. 10,00,000/-] and installment of next four months i.e. 9th month to 12th month shall be Rs. 1,00,000/- (Rupees one lac) each [Total will be Rs. 4,00,000/-]. C. If petitioner fails to comply with the aforesaid direction of this Court, the Court below is free to cancel the bail-bonds of the petitioners.
