1. Heard learned counsel for the petitioner and the learned A.P.P. for the State.

2. The petitioner apprehends arrest in connection with Runnisaidpur P.S. Case No. 373 of 2023 registered under Sections 30(a), 32(i) (ii), 36 and 41(i) (ii) of the Bihar Prohibition and Excise Act.

3. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case due to dirty village politics. Further he submits that petitioner has no concern either with the recovered liquor or container truck.

4. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below

No.74486 of 2023(2) dt.28-11-2023 2/2 within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each/personal bond to the satisfaction of the Exclusive Special Excise Court No. 1, Sitamarhi in connection with Runnisaidpur P.S. Case No. 373 of 2023, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Arvind Srivastava, J) shailendra/- U T
