KUMAR ORAL ORDER 28-08-2018 Heard learned counsel for the petitioners, learned counsel for the informant and learned counsel for the State. Petitioners, who are in custody, seek bail in connection with Makhdumpur (Tehta O.P.) P.S. Case No. 230 of 2016 (S.Tr. No. 115 of 2018) registered for the offences punishable under Sections 302, 120(B) of the Indian Penal Code. Informant is own son of deceased and both the accused are son and grand son of deceased. Allegation is of killing his father by hanging.

It has been submitted by the petitioners that they do not reside within the premises and deceased was living along with informant and they have been made accused on the basis of

Patna High Court Cr.Misc. No.39097 of 2018 (3) dt.28-08-2018 suspicion and except suspicion there is nothing against petitioners. They are in custody since 31.03.2017.

Learned counsel for informant has vehemently opposed the prayer of bail of petitioners.

Considering the aforesaid fact and circumstances of the case let the petitioners named above be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judges-2, Jehanabad in connection with Makhdumpur (Tehta O.P) P.S. Case No. 230 of 2016 (S.Tr. No. 115 of 2018).
