JUSTICE ASHUTOSH KUMAR ORAL ORDER 05-12-2017 The petitioner seeks bail in connection with Sessions Trial No. 530 of 2017, arising out of Kahalgaon P.S. Case No. 427 of 2016 dated 03.12.2016 instituted for the offence under Section 364(A) of the Indian Penal Code. The son of the informant was kidnapped by unknown persons. Later, when the victim was recovered, he gave statement under Section 164 Cr.P.C in which he has not named the petitioner. The name of the petitioner transpired on the confession of a co-accused Divyanshu Jha, who has been granted bail. The petitioner is in custody since 02.02.2017.

Taking into account the aforesaid facts, this Court is inclined to grant bail to the petitioner. The petitioner, above named, is directed to be

Patna High Court Cr.Misc. No.51032 of 2017 (3) dt.05-12-2017 2/2 released on bail on his furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Bhagalpur in connection with Sessions Trial No. 530 of 2017, arising out of Kahalgaon P.S. Case No. 427 of 2016.
