JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-09-2018 The petitioner is in custody since 14.06.2017 in connection with Kamtaul P.S. Case No. 20 of 2018, registered for offences punishable under Sections 392 of the Indian Penal Code. Allegation against the petitioner is of snatching the bag and mobile of the informant and the petitioner is not named in the F.I.R. Later on, he was arrested and motorcycle used in the crime has been recovered from his possession.
Submission of learned counsel for the petitioner is that though he has been identified in T.I.P. but prior to that he has been got identified by the informant in the police station and petitioner is in custody since 07.02.2018 and he is ready to abide by any condition imposed on him for grant of bail.
Patna High Court Cr.Misc. No.41202 of 2018 (3) dt.25-09-2018 2/2 Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances as stated above, at this stage, I am not inclined to enlarge the petitioner on bail. However, once the charge is framed and the trial is commenced, learned Trial Court shall release the petitioner on bail to his own satisfaction.
With the above observation, this application is disposed of.
