2. This application has been filed for cancellation of bail granted to the opposite party nos. 2 to 4 vide order dated 27.06.2024 passed by a Co-ordinate Bench of this Court in Cr. Misc. No. 44524 of 2024 arising out of Pandarak P.S. Case No. 09 of 2023 registered for the offence under Sections 379, 511 of the Indian Penal Code, under Sections 3⁄4 of the Prevention of Damage of Property Act and under Sections 15(2) and 15(4) of the Petroleum and Minerals Pipeline Act, 1962.

3. Learned counsel for the petitioner has submitted that the opposite parties have obtained bail by a co-ordinate Bench of this Court suppressing the fact that they were also being prosecuted under Sections 15(2) and 15(4) of the

Patna High Court CR. MISC. No.79936 of 2024(8) dt.16-07-2026 2/2 Petroleum and Minerals Pipeline Act, 1962 and the same is also apparent from the impugned order. He also submits that the opposite parties have also suppressed their criminal antecedents.

4. Learned counsel for the opposite party nos. 02 to 04 has submitted that the opposite party nos. 02 to 04 have no knowledge about their prosecution under Sections 15(2) and 15(4) of the Petroleum and Minerals Pipeline Act, 1962.

5. Considering the fact that at the time of consideration of bail of the opposite party nos. 02 to 04, chargesheet has been submitted under Sections 15(2) and 15(4) of the Petroleum and Minerals Pipeline Act, 1962 and the same has been suppressed by them.

6. In view of the above, this application is allowed.

7. Accordingly, the bail granted to the opposite party nos. 2 to 4 vide order dated 27.06.2024 passed by a Co-ordinate Bench of this Court in Cr. Misc. No. 44524 of 2024 arising out of Pandarak P.S. Case No. 09 of 2023, is hereby cancelled. They are not directed to surrender as they are already in custody in connection with another case.
