JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-11-2017 The petitioner seeks regular bail in connection with Sahebpur Kamal P.S. Case No. 63 of 2017, registered for offences punishable under Sections 302/34 and 120B of Indian Penal Code and Section 27 of the Arms Act.
Allegation as per F.I.R against the petitioner that he conspired with other accused persons is of killing the deceased as he was a witness in murder case, earlier lodged against the petitioner.
It has been submitted on behalf of the petitioner that there is nothing on record to show that it is the petitioner, who conspired the murder of the deceased and only bald statement has been made in the fardbeyan about conspiracy by this petitioner. Further petitioner has been in custody in this case since 13.04.2017.

Having heard both sides, considering the fact and circumstances of the case and also the fact that as deceased was a witness in a case earlier lodged against the petitioner, as such, there is strong suspicion against the petitioner coupled with the fact that he is accused in sixteen other cases, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, dismissed.
