This is an application for bail in connection with Barun P.S.Case No. 172 of 2015 registered for the offences punishable under Sections 399, 402, 412, 120B of the Indian Penal Code and 25(1-B)(a), 26 & 35 of the Arms Act.

Allegation as per FIR is that police raided the place and arrested several accused persons and later on name of petitioner has come in confessional statement of co-accused. Submission of learned counsel for the petitioner is that he has falsely been implicated in this case as he was in jail since 20.3.2012 and the present case has been lodged in the year 2015 and in this case he is in custody since 13.6.2017. Heard learned APP also.

No.53117 of 2017 (2) dt.15-11-2017 2/2 Having heard both sides and in view of facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad, in connection with Barun P.S.Case No. 172 of 2015, subject to the following conditions :

(1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned, (2) Petitioner shall co-operate in trial and appear on each and every date in court, failing which his bail bond shall be cancelled.
