JUSTICE SANJAY PRIYA ORAL ORDER 24-01-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in Bela P.S. Case No. 108 of 2017 instituted for the offence under Sections-307, 379, 354 & other minor Sections of the Indian Penal Code.
There is allegation against this petitioner that he assaulted the informant with knife causing injury in the finger of his left hand and also on the head.
The injury report has been received along with case diary and the doctor has stated that the left index finger was amputated and there was sharp cut wound on left side of parietal region on head up to bone deep and there was bruise on right side of chest. The injury No. 2 which was amputated left index finger was opined by the doctor to be grievous in nature.
Therefore, seeing the grievous nature of injury, this court is not
Patna High Court Cr.Misc. No.49009 of 2017 (3) dt.24-01-2018 2/2 inclined to grant anticipatory bail to the petitioner. Accordingly, prayer for anticipatory bail stands rejected. The petitioner is directed to surrender in the court below and seek regular bail which will be considered and disposed of on its own merit in accordance with law without being prejudiced by this order.
