The petitioner, who is in custody, seeks bail in connection with Karja P.S. Case No. 41 of 2018 registered for the offence punishable under Sections 399, 402, 414 of the Indian Penal Code and (25-b) a 26/35 of the Arms Act. Allegation against the petitioner is of recovery of one loaded country made pistol and mobile.

It has been submitted on behalf of the petitioner that co-accused has been granted bail by a co-ordinate bench of this Court vide order dated 06.08.2018 passed in Cr. Misc. No. 47718 of 2018. Petitioner has not criminal antecedent and he is in custody since 27.02.2018.

Patna High Court Cr.Misc. No.41997 of 2018(3) dt.11-09-2018 2/2 Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M. 2nd (West), Muzaffarpur, in connection with Karja P.S. Case No. 41 of 2018.

As prayed for on behalf of the petitioner, the petitioner be permitted to correct the prayer portion as ACJM-II in place of ACJM-3rd of this petition.
