====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 26-10-2018 Heard learned counsel for petitioner and learned counsel for the State.

Petitioner, who is in custody, seeks bail in connection with Khodawandpur (Chaurahi O.P.) P.S. Case No. 34 of 2018 registered for the offences punishable under Sections 304-B, 201/34 of the Indian Penal Code.

Informant who is the father of the deceased has alleged that petitioner (husband) along with other family members killed his daughter due to non-fulfillment of demand of dowry.

It has been submitted on behalf of the petitioner that he is innocent. He has been falsely implicated in this case.

Patna High Court Cr.Misc. No.41178 of 2018(4) dt.26-10-2018 2/2 His wife died due to diarrhea. Cremation of the dead body has been done in presence of his family member. It has been further submitted that matter has been compromised between the parties and it was accepted by the parties. Petitioner is in custody since 18.04.2018.

Notices were issued to O.P. No.2 informant and he has appeared and does not oppose the grant of bail to petitioner and states that due to misinformation and misguidance F.I.R. was lodged and now is he satisfied that his daughter died of Diorahea.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Manjhaul, Begusarai in connection with Khodawandpur (Chaurahi O.P.) P.S. Case No. 34 of 2018.
