The petitioner apprehends his arrest in connection with Complaint Case No.622C of 2020, registered for the offences punishable under Sections 498(A) and 323 of the Indian Penal Code.

The petitioner alongwith other in-laws is said to have tortured the complainant physically and mentally for nonfulfillment of demand of additional dowry. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. The petitioner has got no criminal antecedent as stated in paragraph-3 of the bail petition. It is further submitted that there is general and omnibus allegation against all accused persons including the petitioner. It is submitted that the

Patna High Court CR. MISC. No.72350 of 2022(2) dt.21-03-2023 2/2 complainant has already filed maintenance case being Maintenance Case No.101 of 2020 before the learned Principal Judge, Family Court, Araria.

The learned APP for the State opposed the prayer for grant of anticipatory bail to the petitioner. Taking into consideration the facts and circumstances of the case, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Araria in connection with Complaint Case No.622C of 2020, subject to the conditions laid down under Section 438 (2) of the Code of Criminal Procedure.

The petitioner is directed to appear in the maintenance case filed by the complainant. If the petitioner does not appear in maintenance case on two consecutive dates, the complainant would be at liberty to move before the learned court below for cancellation of bail bond of the petitioner.
