JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 07-07-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner seeks bail in connection with Sonepur P.S. Case No.279 of 2016/Sessions Trial No.03 of 2017 registered under Sections 304(B) and 201/34 of the Indian Penal Code besides Sections 3⁄4 of the Dowry Prohibition Act. Learned counsel appearing on behalf of the petitioner submits that, earlier, the prayer of the petitioner for grant of bail was rejected by this Court vide order dated 03.05.2017 passed in Criminal Misc. No.17569 of 2017. The petitioner is in custody since 06.08.2016 but his trial has not been concluded as yet.

Patna High Court CR. MISC. No.71826 of 2019(3) dt.07-07-2020 2/2 passed by this Court regarding the present stage of Sessions Trial No.03 of 2017, arising out of Sonepur P.S. Case No.279 of 2016, has been received from the court of the 5th Additional Sessions Judge, Saran at Chapra, through letter no.418 dated 07.03.2020, which indicates that the record of the case of the petitioner is pending for evidence and the trial of the petitioner may be concluded within three months. However, from the subsequent letter no. 425 dated 18.05.2020 received from the court of the 5th Additional Sessions Judge, Saran at Chapra, it appears that due to present situation of Pandemic COVID-19, the trial of the petitioner could not be concluded as yet.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-XI, Saran at Chapra, in connection with Sonepur P.S. Case No.279 of 2016/Sessions Trial No.03 of 2017.
