Petitioner seeks bail in Muffasil P.S. Case No. 209 of 2015 registered for the offence punishable under Section 395 of the Indian Penal Code.

Informant has alleged in his written complaint that while he was on his way with a Pick-up Van loaded with Cattle towards Sanda Cattle Animal Fair, some miscreants boarded in the Safari Vehicle came in front of the vehicle of the Informant near Chatra More and looted Rs. 5,96,000/- from the informant and other traders.

It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case. FIR is against unknown. It has been further submitted that the name

No.41055 of 2018(3) dt.13-09-2018 2/2 of the petitioner has surfaced in this case on the basis of confessional statement of co-accused Amarjeet Kumar, who has already been granted anticipatory bail. Similarly, situated coaccused persons have been granted bail by co-ordinate benches of this Court vide orders dated 06.12.2016 in Criminal Miscellaneous No. 42217 of 2016, 22.12.2016 in Criminal Miscellaneous No. 46313 of 2016 and 27.02.2017 in Criminal Miscellaneous No. 8071 of 2017. Petitioner is in custody since 15.05.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Muffasil P.S. Case No. 209 of 2015.
