The petitioner seeks bail in a case registered under Sections- 411, 413, 420, 468, 471/34 of the Indian Penal Code. Allegation against the petitioner is that he was apprehended by police with stolen motorcycle.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 09-05-2018 and he has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been made accused in this case due to mistake of fact. The petitioner had purchased the motorcycle in question from one Vikash Kumar. The petitioner had no knowledge that the said motorcycle
Patna High Court Cr.Misc. No.41190 of 2018 (3) dt.14-09-2018 in question was a stolen property. He had purchased the said motorcycle in good faith. The other similarly situated co-accused namely, Vikash Kumar has been granted anticipatory bail by a coordinate bench of this court vide order dated 10-07-2018 passed in Cr. Misc. No. 38129 of 2018.
On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bhojpur, Ara in connection with Dhangai P.S. Case No. 32 of 2018.
