JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-09-2018 Heard the parties. The petitioner seeks regular bail in connection with Charpokhari P.S.Case No. 120 of 2016 registered for the office under Sections 25(1-b)a, 26(i)(ii) Arms Act, 18, 20, 38, 39 U.A.P.A. Act and 17 C.L.A. Act.
As per FIR, allegation against the petitioner is of recovery of rifle, three live cartridges and regular rifle with a double barrel gun from the possession of the petitioner.
Submission of the learned counsel for the petitioner is that for recovery another case has been lodged and there is confession before the police and except that nothing is against the petitioner and he is in custody since 21.05.2016. Heard learned A.P.P. who opposed the prayer for bail and submitted, apart from recovery, he is accused in five other cases.
Having heard both sides and in view of the facts and
Patna High Court Cr.Misc. No.41355 of 2018 (3) dt.25-09-2018 2/2 circumstances, as stated above, I am not inclined to grant bail to the petitioner.
Hence, this application is dismissed.
