The petitioners apprehends his arrest in connection with Turkauliya P.S. Case No. 88/2019 registered under Sections 341, 323, 324, 307, 379, 504 and 34 of the Indian Penal Code. The accusation is that in the evening of 08.02.2019 Sk. Yunus (petitioner no.3) was digging the path connecting to house of informant Khurshid Alam then informant made protest on which Sk. Yunus (petitioner no.3) started to abuse and raise alarm on which Sk. Wasi Akhtar @ Sk. Osi Akhtar (petitioner no.1), Sk. Jamil Akhtar (petitioner no.2) and Sk. Sahib @ Sk. Shaheen (petitioner no.4)

Patna High Court CR. MISC. No.68228 of 2019(2) dt.18-11-2019 2/2 came there having lathi and stick and started to cause assault. In the meantime Sk. Wasi Akhtar @ Sk. Osi Akhtar (petitioner no.1) took the Nokia mobile phone from the pocket and wrist watch, on protest Sk. Yunus (petitioner no.3) gave spade blow at his forehead on raising alarm Majhar Alam, Sk. Samkul Haque, Noor Alam and Sk. Imran cane and specified the matter.

Learned counsel for the petitioners submits that due to land dispute occurrence took place in which informant sustained only two injuries which are simple in nature. Petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Turkauliya P.S. Case No.88/2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
