This is an application for regular bail in connection with Gurua P.S. Case No. 64 of 2018 registered for the offences punishable under Section 413, 414 and 411 of the Indian Penal Code.
Informant, who is Sub Inspector of Gurua P.S. has stated in his written complaint that on 13.04.2018 when he along with his other police personnel was on vehicle inspection at Barhi Bigha More, he saw one person driving a Pulsar motorcycle at very high speed and on seeing the police party he started fleeing away but he was caught after chase, who disclosed his name as Deepak Kumar (petitioner). It has been further alleged that
Patna High Court Cr.Misc. No.43436 of 2018 (3) dt.12-09-2018 petitioner did not produce any document of the said motorcycle and told that he purchased the said vehicle from one Vikash Kumar.
It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been falsely implicated in this case. Nothing has been recovered from the possession of the petitioner or from his house. He has no criminal antecedent and he is in custody since 14.04.2018. It has been further submitted that similarly placed co-accused Vikas Kumar has been granted bail by co-ordinate Bench of this Court in Cr. Misc. No. 39844 of 2018 vide order dated 26.07.2018. Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each of the satisfaction of Shri G.N. Dubey, learned J.M. 1st Class, Sherghati (Gaya) in connection with Gurua P.S. Case No. 64 of 2018.
