JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 31-10-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Ramnagar P.S. Case no. 165 of 2017, registered under Sections 376, 313, 504/34of the Indian Penal Code and Section 3 and 4 of the Dowry Prohibition Act.

The accusation is that before two years Ranjit Choudhary developed physical relation with the complainantinformant on the pretext to perform marriage with her in the meantime, complainant-informant conceived pregnancy then she gave pressure upon Ranjit Choudhary, son of the petitioner, to perform marriage, but he did not take any heed on it. Thereafter, complainant-informant disclosed about her physical relation with Ranjit Choudhary, son of the petitioner, then Panchayati was arranged, but his father Mohan Choudhary (Petitioner) and his other family members refused to obey the decision of the Panchayat. No.51171 of 2017 (2) dt.31-10-2017 2/2 complainant-informant approached to the petitioner father of Ranjit Choudhary, but he refused to perform marriage, while they assured the parents of the complainant-informant to perform marriage with Ranjeet Choudhary and accordingly the date of marriage was fixed on 14.04.2017 and place of marriage was fixed as Shiv Temple but later on petitioner and other family members demanded Rs. One lakh and motorcycle.

Learned counsel for the petitioner submits that it would appear from the F.I.R. that the complainant-informant developed physical relation with the son of the petitioner and she started to give pressure upon the petitioner to settle the marriage and this case also been filed so that son of the petitioner may perform the marriage with the complainant-informant.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the S.D.J.M. Bagaha, West Champaran in connection with Ramnagar P.S. Case No. 165 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
