The petitioner seeks bail in connection with Sigori P.S. Case No. 6 of 2016, registered under Section 304B/34 of the Indian Penal Code.

The accusation is that cousin sister of the informant, Ratnesh Kumar, was set on fire in the evening of 18.01.2016 and was rushed in burnt condition to Patna Medical College and Hospital where she died in course of treatment. Informant, further, claimed that earlier his sister was being tortured by her husband and in-laws for demand of dowry, due to that reason, she was put on fire and ultimately she died.

Submission is that in fact cousin sister of the informant was the wife of the petitioner and she sustained burn

Patna High Court CR. MISC. No.72174 of 2019(3) dt.04-03-2020 2/2 injury in course of cooking the meal and she was rushed to Patna Medical College and Hospital, but, after the death, the informant, who is the cousin brother of the deceased, lodged the present case with false allegation. But, later on, knowing the real fact, informant has filed the application about lodging the case on receiving false information about putting her cousin sister on fire by husband and in-laws. The petitioner is in custody since 15.02.2019.

Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Sigori P.S. Case No. 6 of 2016 to the satisfaction of the Additional Chief Judicial Magistrate, V, Danapur, Patna. (Rajendra Kumar Mishra, J) Shamshad/- U T
