2. The petitioner is in custody since 29.06.2023 in connection with Barahat P.S. Case No. 142/2023 registered for the offence punishable under Sections 25(1-b)a, 26/35 Arms Act.

3. As per the prosecution case, one country made pistol and two cartridges have been recovered from the petitioner.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He further submits that nothing incriminating has been recovered from the possession of the petitioner. The petitioner has no criminal antecedents.

5. Learned Additional Public Prosecutor appearing on

Patna High Court CR. MISC. No.74483 of 2023(2) dt.29-11-2023 2/2 behalf of the State has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Barahat P.S. Case No. 142/2023.
