The petitioner, already in custody, seeks bail in connection with Special (N.D.P.S.) Case No. 24 of 2018, arising out of Bakhtiyarpur P.S. Case No. 158 of 2018 registered under Sections 20/22 N.D.P.S. Act and 25(1-b)a/26/35 of Arms Act. This is the second bail application filed by the petitioner. Earlier prayer of bail of the petitioner was rejected vide order dated 15.05.2018, passed in Cr. Misc. No. 30274 of 2018, as the petitioner was in custody only for one month. Now the contention of the learned counsel for the petitioner is that the recovery of one country made pistol with one live cartridge is shown against the petitioner but the petitioner has no criminal antecedent and he has remained in custody for four months.
