2. This is the 2nd attempt of the petitioner. Earlier the bail application of the petitioner was rejected vide order dated 19.03.2024 passed in Cr. Misc. No. 84260 of 2023.

3. The petitioner seeks regular bail in connection with Jaynagar P.S. Case No. 112 of 2023 registered for the offence under Sections 302, 201, 120(B) of the Indian Penal Code and later on Section 376D was added.

4. Learned counsel for the petitioner submits that out of 9 witnesses, 5 witnesses have been examined in the case. Petitioner is in custody since 05.05.2023.

5. Learned A.P.P. has vehemently opposed the prayer

Patna High Court CR. MISC. No.77760 of 2024(2) dt.17-12-2024 2/2 for bail.

6. In view of the law laid down by the Hon'ble Supreme Court in the case of X vs. State of Rajasthan & Anr, 2024 SCC OnLine SC 3539, I do not find this case to be a fit case for grant of regular bail.

7. Accordingly, this application for regular bail is rejected.
