ANJANA MISHRA ORAL ORDER 21-08-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 29.05.2018 in connection with Warisaliganj P.S. Case No.76 of 2018 registered for the offence under Section 365 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner has no role to play in the alleged elopement and marriage of the daughter of the informant. It is further submitted that it has come on record that the victim girl has, in fact, married Niraj Kumar and the only thing which has come is that it has been stated that the petitioner had helped her in eloping with said Niraj Kumar. Patna High Court Cr.Misc. No.44817 of 2018 (3) dt.21-08-2018 2/2 petitioner thus submits that in view of such materials surfacing in the case diary, it is in the interest of justice that the petitioner may be released on bail.
Diary in the present case was called for, which has since been received.
Learned counsel for the State after perusal of paragraph 50 of the case diary, which is the statement of the mother of the victim girl, submits that it is indicated therein that the petitioner had a limited role to play.
In view of the aforementioned facts and circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Nawada, in connection with Warisaliganj P.S. Case No.76 of 2018.
